Police not registering your FIR? What to do in India
Updated 2026-10 · General information, not legal advice.
A police officer must register an FIR for a cognizable offence. If the station refuses, there are steps you can take, ending with the Magistrate.
When to use this
- The police will not register your complaint
- You were told to come back later or settle privately
- You gave a complaint but got no FIR or receipt
Step by step
- 1
Give a written complaint and ask for a receipt
Write the facts clearly with dates and names. Ask the station to acknowledge it in writing or by stamp.
- 2
Try any police station
For serious offences you can approach any police station; the case can be registered there and transferred (a "zero FIR").
- 3
Send it to the Superintendent of Police
If the station refuses, send the same complaint by post or email to the Superintendent of Police of your district.
- 4
Approach the Magistrate
If there is still no action, you can apply to the Magistrate, who can direct the police to register an FIR and investigate. A lawyer helps here.

Common questions
Can I get a free copy of the FIR?
Yes. The informant is entitled to a copy free of cost.
Is a police complaint the same as an FIR?
No. An FIR is the formal registration for a cognizable offence. Keep asking for it in writing if the offence is serious.
