Employer not paying salary? How to complain in India

Salary is a legal right. Start by putting your demand in writing, then escalate to the labour authorities, and use a legal notice if the employer still does not pay.

When to use this

  • Salary has been delayed or withheld
  • Full and final settlement was not paid after you left
  • The employer is making unexplained deductions

Step by step

  1. 1

    Collect your records

Offer letter, salary slips, bank statements, attendance and any messages about the dues.

  2. 2

    Send a written demand

Email HR and your manager with the amount due and a clear date. Keep a copy.

  3. 3

    Complain to the labour office

File with the Labour Commissioner or Assistant Labour Commissioner for your area. Whether your case falls under it depends on the type of establishment and your role.

  4. 4

    Send a legal notice

A notice from an advocate sets a final deadline and is a base for further action, such as a civil recovery claim.

Key facts

  • Do not resign or sign a "no dues" paper before you are paid
  • Keep payslips and bank statements
  • Which authority applies depends on your state and employer

Common questions

Can I complain if I have no appointment letter?

Yes. Bank credits, payslips, messages and colleagues' statements can show you worked and were paid.

Should I go to the police?

Not usually for unpaid salary alone. Start with a written demand and the labour office.
